Terms & Conditions of the Partner Program

In these terms, the following terms have the meaning indicated:

• "NordikServer" or "we" — refers to NordikServer, Inc., a Canadian company operating nordikserver.com.
• "Partner" or "Affiliate" — refers to any individual or legal entity accepted into the program and holding an active tracking link.
• "Referred client" — refers to any new customer who made a qualifying first purchase via the Partner's link or code.
• "Commission" — refers to the percentage of the pre-tax amount of a recurring order paid to the Partner.
• "Program" — refers to the NordikServer partnership and affiliate program as a whole.
• "Strategic Partnership" — refers to an individually negotiated commercial agreement, distinct from the standard affiliate program.

To be eligible for the Program, you must:

• You must be at least 18 years old.
• Submit a complete and honest application via the official form.
• Not have been previously banned or excluded from the Program.
• Operate a platform, community, or audience in compliance with applicable laws.
• Not be a direct competitor of NordikServer in server hosting sectors.

Commissions are calculated on the pre-tax amount of each renewal from an active referred client. The applicable rate depends on your tier at the time of renewal:

Tier progression is automatic and immediate. A tier regression occurs if the number of active clients falls below the required threshold for two (2) consecutive cycles.

• Validation period: Commissions are validated 30 days after the referred client's order activation, to cover the possible refund period.
• Frequency: Payments are made monthly, within the first 10 days of the month following validation.
• Accepted methods: PayPal, bank transfer (Interac e-Transfer for Canadian residents), or credit on your NordikServer account.
• Currency: Payments are made in Canadian dollars (CAD) by default, unless otherwise agreed.
• Minimum threshold: No minimum threshold required. All validated balances are paid out.

In the event of a dispute over a commission amount, the Partner has 60 days from the payment date to submit a written claim to our team.

As a Partner, you agree to promote NordikServer honestly, transparently, and in accordance with applicable advertising practices.

• Mandatory disclosure: You must clearly indicate to your audience that you participate in a paid affiliate program (mention "affiliate link", "sponsored partnership" or equivalent).
• Accuracy of information: Any information communicated about NordikServer services must be accurate and up to date. When in doubt, consult our team.
• Asset usage: You are authorized to use logos, banners, and visuals provided in the official marketing kit only. Any modification is subject to prior approval.
• SEO & paid advertising: Paid search on the brand name "NordikServer" or its variants is prohibited without prior written authorization.
• Spam: Any promotion through unsolicited email (spam), non-consented mass Discord messages, or similar aggressive practices is strictly prohibited.

The following behaviors will result in immediate account termination and forfeiture of all pending commissions:

NordikServer grants you a limited, non-exclusive, non-transferable, and revocable license to use the provided brand elements (logos, banners, trade name) exclusively within the scope of the Program.

• You may not register a trademark, domain name, or social media account using "NordikServer" or a similar variant.
• Any use of brand elements outside approved materials requires prior written authorization.
• This license terminates automatically upon termination of the Partner account, regardless of cause.

NordikServer retains all intellectual property rights over its services, software, trademarks, and content. The Program does not confer any ownership rights over these elements.

By participating in the Program, you agree that NordikServer collects and processes data necessary for its proper operation, including:

• Your profile information (name, email address, main platform).
• Performance data (clicks, conversions, commissions generated).
• Your payment information (necessary only for commission disbursement).

This data is processed in accordance with our Privacy Policy. You have the right to access, correct, and delete your personal data.

Voluntary termination: You may leave the Program at any time by sending a written request to our support team. Commissions validated before the termination date will be paid according to the usual schedule.

Termination by NordikServer: NordikServer may terminate your participation in the Program at any time, with 15 days notice by email, except in cases of serious violation of these terms (immediate termination without notice).

The Program is provided "as is". NordikServer does not guarantee a minimum income level, permanent program availability, or that your application will be accepted.

• NordikServer is not responsible for income losses resulting from technical changes, temporary dashboard unavailability, or commission rate modifications.
• You are an independent contractor, not an employee, agent, or legal representative of NordikServer.
• NordikServer's total liability to you is limited to the amount of validated commissions not yet paid at the time of the dispute.

NordikServer reserves the right to modify these terms at any time. In case of substantial modifications (commission rates, payment methods, conduct rules), a 30-day notice will be communicated by email and/or through your partner dashboard.

Continuing your participation in the Program after the new terms take effect constitutes acceptance of them. If you refuse the modifications, you must terminate your participation before the effective date.

These terms are governed by and interpreted in accordance with the laws of the province of Quebec and applicable federal laws of Canada, without regard to conflict of law principles.

Any dispute arising from the Program shall be subject to the exclusive jurisdiction of the competent courts of the province of Quebec, Canada. We nevertheless encourage amicable resolution of any dispute before any legal action.
