These Terms and Conditions govern your use and access to NordikServer's nordikserver.com and present a legally binding contract between you and NordikServer. NordikServer may be referred to as "NordikServer", "we", "us", or other first-person pronouns and you may be referred to as "customer", or other second-person pronouns. These terms apply to all users, whether paid members, contributors, active or passive users, or visitors.
NordikServer offers online-based services, including game servers and internet web hosting. These services may be referred to as "our services", "products", etc.
By accessing or using our services, you confirm (i) that you are 13 years of age and the minimum age of digital consent in your country, (ii) if you are the age of majority, that you have read, understood, and accept to be bound by these Terms, and (iii) if you are between 13 and the age of majority, that your legal guardian has reviewed and agrees to these Terms.
We reserve the right to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner.
The initial service term begins on the date NordikServer generates an e-mail announcing account activation and continues for the first partial month plus the number of full calendar months stated in the order. Upon expiration, this agreement automatically renews unless either party provides notice of non-renewal at least seven (7) days prior to expiration.
Fees are payable in advance on the first day of each billing cycle. Customer is responsible for providing complete and up-to-date payment information.
An additional grace period of three (3) calendar days is granted following the invoice due date, during which no late fee or penalty shall be applied and the service will remain active.
After the grace period, any unpaid balance may be subject to late interest at two percent (2%) per month, calculated monthly on the outstanding amount until full payment is received.
NordikServer reserves the right to suspend or limit any service for which the invoice remains unpaid after the grace period, without further notice. Suspension does not relieve the customer from the obligation to pay all amounts due.
Reactivating a service suspended for non-payment may incur a fixed administrative reactivation fee of ten Canadian dollars (CA $10), payable before or at the time of reactivation.
In certain cases, including where suspension or termination results in technical or administrative work, additional reasonable fees may be charged. Customer agrees to pay NordikServer's reasonable costs of collection, including collection agency fees, chargeback fees, and legal fees.
NordikServer may increase fees effective the first day of a renewal term by giving at least forty-five (45) days notice. Fee increases due to currency rate fluctuations will not yield any notice to customers.
At NordikServer's request, customer shall remit all sales, VAT or similar tax imposed on the provision of the services.
Any promotions offered by NordikServer are valid where stocks last. NordikServer reserves the right to add, remove, or modify any promotion at any time without notification.
NordikServer bases all pricing from Canadian Dollars (CAD). Prices in other currencies may fluctuate rapidly at any time, including during an ongoing billing period.
NordikServer may suspend or terminate services without notice if: (i) services are being used in violation of the AUP, (ii) customer fails to cooperate with any investigation of a suspected violation, (iii) suspension is necessary to protect the network or other customers, or (iv) requested by a law enforcement agency.
Either party may terminate the agreement with ten (10) days notice for material breach, or immediately in cases of repeated AUP violations. Unpaid fees for the remaining term become due on the business day following termination.
Customer agrees to use the service in compliance with applicable law and the AUP. NordikServer may amend the AUP from time to time. In the event of a dispute regarding interpretation of the AUP, NordikServer's commercially reasonable interpretation shall govern.
NordikServer does not guarantee the availability of any host locations and reserves the right to add, move, modify, or remove any location at any time without notification. NordikServer also reserves the right to deny the transfer of any account to a new location for any or no reason.
FriendPay allows customers to accept payments from their users. Any payments received are made on behalf of the customer, and all fees (except processor fees) are the sole responsibility of the customer. Failure to pay these fees will result in termination of all customer services.
Customer agrees to defend, indemnify and hold harmless NordikServer, its affiliates and their respective directors, officers, employees and agents from all claims and expenses (including reasonable attorneys fees) brought by a third party arising out of or related to the actual or alleged use of customer's services in violation of applicable law or the AUP.
NordikServer does not warrant that the services will be uninterrupted or error-free. To the extent permitted by applicable law, NordikServer disclaims any and all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. All services are provided on an "as is" basis.
The maximum aggregate liability of NordikServer shall not exceed the amount payable by customer for three (3) months of service. Neither party shall be liable for lost profits or any indirect, special, incidental, consequential or punitive damages. Customer acknowledges it is solely responsible for interactions with end users of its site or service.
NordikServer may, without notice to customer, report to authorities any conduct reasonably believed to violate applicable law, and provide any information it has about customer in response to a formal or informal request from a law enforcement or regulatory agency.
Your use of NordikServer's services is at your sole risk. NordikServer is not responsible for files and data residing on your account. You agree to maintain all appropriate backup of files and data. Any backup services provided by NordikServer, whether paid or not, are offered with no warranty of their date, accuracy, or integrity.
Upgrades and other changes in NordikServer's network, including changes in software, hardware, and service providers, may affect customer's hosted content or applications. NordikServer reserves the right to change its network at its discretion and shall not be liable for any resulting harm.
Customer credit cannot be paid out in any form, to any bank account or services, unless in extenuating circumstances that have been pre-approved by NordikServer Administration.
Notices to NordikServer shall be given via electronic mail to the address posted on nordikserver.com. Notices to customer shall be given via electronic mail to the primary customer contact. Notices are deemed received on the day transmitted.
NordikServer shall not be in default of any obligation if failure to perform is due to any event beyond its control, including significant failure of the power grid or internet, natural disaster, war, riot, insurrection, epidemic, strikes, terrorist activity, or other events of a magnitude for which precautions are not generally taken in the industry.
This agreement shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, excluding any conflict-of-law rules.
Exclusive venue and jurisdiction for all disputes shall be the courts located in the judicial district of Montreal, Province of Quebec, Canada, and each party irrevocably submits to such jurisdiction.
Certain NordikServer services allow the installation of third-party games, mods, plugins, or other content. These are developed and maintained by external publishers over which NordikServer has no control.
The customer expressly acknowledges that:
NordikServer shall not be liable for damage arising from publisher updates, installation of mods or plugins, or a game version no longer being supported. Where reasonably possible, NordikServer may offer workarounds at its discretion, without obligation of result.
NordikServer's services are provided on a shared resources basis (CPU, memory, storage, bandwidth, I/O, etc.), unless otherwise explicitly stated. Actual performance may vary depending on number of players, game type, installed mods, and overall infrastructure load.
NordikServer does not guarantee any specific performance level nor compatibility with any particular combination of mods, plugins, or custom configurations.
NordikServer reserves the right to limit or adjust resource usage in case of abusive usage or negative impact on infrastructure stability, with or without prior notice.
The customer remains solely responsible for any and all content, data, files, mods, maps, plugins, scripts, images, sounds, trademarks, or copyrighted works installed, uploaded, or distributed through NordikServer's services.
The customer warrants holding all rights, licenses, and permissions necessary to use and distribute such content. NordikServer is not a party to any license agreements between the customer and third-party publishers.
NordikServer may, at its sole discretion and without prior notice, suspend, limit, or remove any content where it has reasonable basis to believe such content infringes intellectual property rights, violates applicable law, or breaches these Terms.
NordikServer's technical support is limited to the infrastructure it directly controls (hardware, network, management panel, operating system, automated installations provided by NordikServer).
Unless otherwise expressly stated, NordikServer is not required to configure or maintain mods, plugins, or third-party content, correct errors specific to a game or mod, or guarantee performance for complex configurations.
Any assistance provided free of charge for out-of-scope items is provided without warranty, without obligation of result, and may be interrupted at any time.
Certain games or platforms hosted through NordikServer's services, including FiveM (operated by Cfx.re), are subject to the terms of service of their respective publishers, including Rockstar Games. NordikServer is not affiliated with, approved, sponsored, or endorsed by any such publishers.
The customer is solely responsible for full compliance with the terms of service of any game platform they operate, including but not limited to:
In particular, any customer operating a FiveM server agrees to display prominently on any website, storefront, or public-facing interface related to their server the following disclaimer (or any equivalent wording approved by Cfx.re):
NordikServer shall not be held liable for any customer's failure to comply with a third-party publisher's terms of service, nor for any resulting consequences, including server suspension or shutdown by such publisher. In the event a third-party publisher files a complaint against NordikServer arising from the customer's server content or operation, NordikServer reserves the right to immediately suspend the relevant service without prior notice.
